NOTE: 1.
All loose parts belonging to any of the lots will
bear the 2.
The specifications for the machines are set out
only as a guide for the participants. 3.
The Auction will be conducted at the site near
each machine as far as possible, in the order that the machines have been
arranged. The auction will not be in
the serial order of lot number. 4.
Amendments, if any, will be announced at the time
of Inspection/ Auction. CONDITIONS OF
1.
The sale is under instructions from Ashok Leyland Ltd., Ennore,
Chennai, hereinafter referred to as the Company. All bids are subject to
acceptance by the Company. The Company reserves the right to accept or reject
any of the bids without assigning any reason whatsoever. 2.
Any person bidding in the auction shall be deemed to be aware of the
terms and conditions of the material being sold and shall be deemed to have
agreed to such terms and conditions. 3.
The goods are sold in ‘As is where is’ and whatever there is
condition. Intending bidders should
inspect the lot/s offered for sale before purchase and satisfy themselves
about the conditions, description, quantity, size, measurements and other
particulars, since no complaint of any kind will be entertained after the
sale. No warrantee or guarantee is
given. The principle of ‘Caveat
Emptor’ will apply. 4.
A deposit of 25% of the bid amount, subject to a minimum of
Rs.2000/-, by Cash/ Pay Order/ Demand Draft, should be paid immediately the
lot is knocked down. For bid amount of Rs.2000/- and less full amount should
be paid on the spot. Higher percentage
of deposit up to full amount may also be demanded if considered necessary.
The purchaser shall give his name, address, PAN and TIN to the
representatives of the Auctioneers along with the deposit and ensure that the
details are recorded correctly in the bid sheet. The purchaser shall also
sign the bid sheet, acknowledging his purchase, subject to the conditions of
sale. Normally, no change of name and address would be permitted and Ashok
Leyland Ltd. would raise, invoice after receipt of payment, only on the
original purchaser whose name is recorded in the bid sheet. Request for name
change will not be considered under any circumstances. Invoices would be
raised only in favour of purchasers who have valid PAN & TIN. In the
event of the purchaser not possessing the same, the sale would not be
concluded in his favour and the deposit paid by any such bidder, who do not
have valid PAN & TIN will stand forfeited to Ashok Leyland Ltd. 5.
The balance of purchase price, together with Excise Duty as
applicable and VAT as per TNVAT Act should be paid within EIGHT working days
from the date of auction (excluding the date of auction), at 6.
In case the balance amount is not paid within the period as stated in
Clause above, the Company may at their discretion grant permission to the
purchaser to remit the balance sale value for a further period of TWO days
subject to payment of late payment charges at 0.50% per day on the balance
sale value subject to a minimum of Rs.500/- per day of default. No further
extension would be allowed for payment. If after expiry of the time for
payment, after extension if any, the purchaser has not paid the balance
amount, the deposit amount paid by the purchaser will be forfeited to Ashok
Leyland Ltd. and the lot will be resold either by private negotiations or by
public auction at the risk and expense of the defaulting purchaser. 7.
The lot fully paid for as per Clauses above should be taken delivery
of by the purchaser at his expense. The free time allowed for taking delivery
of lots paid for as per clause above is FIFTEEN days from the date of auction
(excluding the date of auction). Schedule for taking delivery shall be fixed
by the purchaser with Ashok Leyland Ltd., through the Auctioneers and
delivery will be permitted only as per the schedule. If the purchaser, after
payment of the balance amounts, approached Ashok Leyland Ltd. for taking
delivery of the machines, without scheduling the same at least 24 hours in
advance, Ashok Leyland Ltd. will be compelled to refuse delivery and return
the vehicle of the purchaser. The purchaser shall not be entitled to any
compensation for reason of Ashok Leyland Ltd. not permitted un-scheduled
delivery. If for any reason, the purchaser does not indicate his preferred
schedule for delivery, Ashok Leyland Ltd. shall schedule the same by
themselves and the purchaser shall abide by the same. In any event the
delivery should be completed within 15 days from the date of auction
(excluding the date of auction). 8.
To ensure safety during
machines delivery operation, the following guidelines should be strictly
followed by the buyers: a) Escorts
mobile crane hook should have safety latch b) Good condition of belt rope and
load test certification c) Hook maximum load carrying capacity should have
been written in all hook places & d) Driving Licence should be brought
compulsorily at the loading time.

If the goods are not removed within FIFTEEN working days, the Company
may at its discretion, grant extension of time for clearance to a maximum of
TWO days, subject to the purchaser paying ground rent at the rate of 0.50%
subject to a minimum of Rs.500/-, on the sale value per day of default. In
the event of the purchaser making payment after expiry of the free period
allowed, free time for taking delivery would be allowed for FIVE working days
from the date of payment (excluding the date of payment) 10.
Deliveries will be permitted only on working days of Ashok Leyland
Ltd. (Tuesday to Sunday) between 8:00am and 3:00pm, with normal lunch break. 11.
If the lots are not removed by the purchaser within the time allowed,
including extension if any, the amounts paid will automatically be forfeited
to Ashok Leyland Ltd. and the materials will be disposed of either by public
or private sale and the purchaser will have no claim whatsoever over the
materials or on the amount paid. 12.
Excise Duty indicated against the lot(s) as applicable and VAT as per
TNVAT Act, should be paid extra along with balance sale value. VAT will be charged at 4% for all
purchasers registered under the TNVAT Act, subject to production of certified
copy of their Tamil Nadu TIN Registration Form and a declaration in the
format required by Ashok Leyland Ltd. The
format can be perused at Murray & Co., or at Ashok Leyland Ltd., Ennore
at the time of inspection. Form ‘C’ will not be accepted. 13.
The Company reserves the right to increase or decrease the quantity
in the lot and of withdrawing any lot from the sale. The Company also
reserves the right to identify the items belonging to the machinery/equipment
and their decision is final. 14.
From the time of acceptance of the bid, the lot will remain in every
respect at the risk of the purchaser. 15.
The decision of the Officer supervising the sale will be final and
binding on all parties attending the auction. 16.
The successful bidder shall engage his/their own employees or labour
and transport for clearance of the machinery, equipment from the Company
premises at his/their cost subject to the Company security, discipline and
regulations 17.
The successful bidder should inform the Company in writing of the
details of employees, labourers to be engaged by him/them for removal of the
machinery/equipment and also should give the Company an undertaking that
he/they will be responsible for the conduct and behavior of the employees/
labourers engaged by him/them. If any
purchaser or his authorised employee/labourer indulges in any malpractice
whatsoever detrimental to the interest of the Company, action will be taken
against such person involved as per Company security regulations. The purchaser should also ensure that no
person below the age of 18 years or no woman labourer is engaged by him/ them
in this behalf. 18.
The Company will not and cannot be held responsible and liable for
any injury or death that may be caused either to the successful bidder or
his/ their representative/ labourers resulting from accidents or any other
cause while working within Company premises. 19.
The successful bidder should undertake to reimburse the Company for
any damage/s or loss caused to its employees or property while taking
delivery of the machinery/equipment purchased or due to any cause in which
the successful bidders’ representative/ labourers/ transport are involved. 20.
The Company reserves the right to amend any or all the Conditions of
sale and all Conditions/ additional clauses announced prior to the
commencement of the auction shall be binding on all the participants. 21.
All persons taking part in the auction will be deemed to have
expressed their acceptance to all the conditions of sale. MURRAY
